1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Agamkuan Police Station Case No. 646 of 2024, disclosing offences under Sections 406, 420, 504, 506, 34 of the Indian Penal Code.
3. First information report has been lodged by one Sudhir Kumar Singh stating that the petitioner was appointed as employee in the company in the name and style of Creative Mart Marketing Pvt. Ltd. having its office at Transport Nagar. The petitioner had taken a loan of Rs 1 lakh in cash in the year 2023, thereafter, he left the job. When the informant demanded his money back, on one pretext or other, the petitioner did not return the money and threatened to lodge a case if the money
Patna High Court CR. MISC. No.24327 of 2025(2) dt.02-05-2025 2/3 would be demanded. It has further been alleged that on 26.07.2024, the petitioner's wife threatened the informant on phone that if the money would be demanded, the informant would be implicated in a case of kidnapping of her husband.
4. Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case after case of kidnapping of petitioner was lodged on 26.07.2024 by his wife. The informant has been made accused in the case lodged on 26.07.2024 by the wife of the petitioner and subsequently, thereafter, the present FIR has been lodged by the informant on 30.07.2024. She further submits that another FIR bearing Agamkuan P.S. Case No. 647 of 2024 under Section 406 and 420 of the IPC has been lodged by one of the employees of the company and at the behest of the informant in which petitioner is on bail.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation made in the FIR which shows the dispute due to nonpayment of loan by the petitioner, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of

No.24327 of 2025(2) dt.02-05-2025 3/3 his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Patna City, in connection with Agamkuan Police Station Case No. 646 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
