The petitioner seeks regular bail in connection with Bhore Police Station Case No. 53 of 2020, registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016 and Sections 8(C)/21 (a) of the Narcotic Drugs and Psychotropic Substances Act, 1985. This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 16.10.2020, passed in Criminal Misc. No. 26779 of 2020, giving liberty to the petitioner to renew his prayer for bail after six
Patna High Court CR. MISC. No.32782 of 2021(2) dt.14-06-2021 2/3 months from the date of the order.
The allegation against the petitioner, as per the First Information Report, is that 4.1 gms of smack as well as 600 ml of illicit country-made liquor was recovered from his possession.
Learned Counsel for the petitioner submits that the quantity of smack recovered from the possession of the petitioner is less than the small quantity and the petitioner is in custody since 24.02.2020. He further submits that charge sheet has been submitted against the petitioner and, as such, there is no likelihood of the petitioner being abscond or tamper with the evidence.
After having heard learned Counsel for the parties and taking into consideration the fact that the petitioner is in custody since 24.02.2020 and charge sheet has been submitted against him, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail, upon furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cumSpecial Judge, Excise, Gopalganj, in connection with Bhore
