====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-12-2021 Heard Mr. Pramod Mishra, learned counsel for the petitioner and Mr. Ataur Rahman, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Supaul P.S. Case No. 765 of 2020 registered for the offence punishable under Section 392 of the Indian Penal Code 1860. Subsequently, Section 411 of the Indian Penal Code was added.

The allegation in short is that the informant was intercepted by three unknown miscreants who snatched the Motorcycle, Rs.9,500/- cash, Mobile phone etc. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the

Patna High Court CR. MISC. No.33799 of 2021(2) dt.22-12-2021 2/3 basis of recovery of the looted Mobile from his possession. Learned counsel further submits that in fact, the brother of the petitioner is a person of criminal antecedent and he has also been made accused in the present case. He next submits that the looted Mobile was kept in the joint house of the petitioner. The petitioner is in custody since 5.2.2021 and he has got no criminal antecedent.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 5.2.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 765 of 2020.

It is made clear that at the time of furnishing bail
