It appears that issue was initially referred to a Larger Bench and by order dated 04.08.2014 it was remitted to the learned Single Judge for hearing holding that the matter at issue is no more res integra in view of the judgments of the Full Bench of this Court in the case of Shambhu Saran Vs. The State of Bihar reported as 2000

(1) PLJR 665 and the Hon'ble Supreme Court in the Case of State of U.P. Vs. C.L. Agrawal reported as (1997) 5 SCC 1.

3. In the aforesaid background and taking into account the fact that nobody has appeared to press the writ petition, the same stands dismissed.
