JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and learned A.P.P. for State.

The petitioner prays for anticipatory bail in connection with Jokihat P.S. case no. 87 of 2016 registered for the offences punishable under Sections 341, 323, 354(B), 379, 504, 506 of the Indian Penal Code.

It has been submitted on behalf of petitioner that petitioner is falsely been implicated in this case as he was making complaint against informant as she used to withdraw the amount meant for mid-day meal, as such present case has been filed making allegation that he had snatched her money and harassed the informant. Above allegation is false and the same has been made with a view to make the offence serious. Heard learned A.P.P.

No.48253 of 2016 (2) dt.16-12-2016 2/2 Having heard both sides and in above facts and circumstances, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on provisional bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. case no. 87 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a direction to watch the conduct of the petitioner for a period of three months as to find out whether he is harassing the informant or not and only after that, his provisional bail will be confirmed otherwise the lower court will cancel his bail bond.

With these observations, this application is disposed of.
