This application, for grant of anticipatory bail, arises out of Forbesganj Police Station Case No. 560 of 2018, disclosing offences under Sections 147, 149, 341, 323, 307, 504, 506 of the Indian Penal Code.

There are twelve persons named in the First Information Report. All of them belong to the same family. There is a counter case also in relation to the same occurrence, said to have taken place on the same date and time. Learned Counsel appearing on behalf of the petitioner has submitted that there is general and omnibus allegation against all the persons of committing assault. There is specific

Patna High Court CR. MISC. No.23434 of 2019(2) dt.11-04-2019 2/2 allegation against the petitioner of having assaulted one Vijay Rai in his leg. The injury, he submits, appears to be grievous. Considering the genesis of the occurrence and nature of accusation, this application is allowed.

Let the petitioner, Madan Roy, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj Police Station Case No. 560 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
