The petitioner seeks bail in connection with Mohammadpur P.S. Case No. 12 of 2024 instituted for the offence under Sections 341, 323, 324, 307, 327, 354B, 384, 504 & 506/34 of the Indian Penal Code.

Prosecution case in short is that on 16-01-2024 when the informant was going to his farm he saw that accused persons including the petitioner were constructing one hut in his farm. When he asked them as to why there were doing so, they

Patna High Court CR. MISC. No.29266 of 2024(2) dt.20-04-2024 2/3 demanded Rs. 5,00,000/- as ransom or either pay the same by executing sale deed of 1 katha and 15 dhur of land from the said farm. It is further alleged that petitioner has given knife blow to the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 05-02-2024. Petitioner bears one criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is subsisting land dispute between the parties. It is submitted that injury is found to be simple in nature. It is lastly submitted that petitioner has also filed a case bearing Complaint Case No. 944(c)/2018.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and injury being simple in nature, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court CR. MISC. No.29266 of 2024(2) dt.20-04-2024 3/3 two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Mohammadpur P.S. Case No. 12 of 2024.
