The petitioner seeks bail in connection with G.R. No. 1158 of 2023 arising out of Baisi P.S. Case No. 98 of 2023 registered for the offence under Section 365/34 of the Indian Penal Code and later on Section 302/201 of the Indian Penal Code was added.

Allegation against the petitioner is that the petitioner along with other co-accused persons done unpleasant incident with the husband of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case due to political rivalry. He further submits that the petitioner is not named in the FIR and there is

Similarly situated co-accused persons have already been granted bail by the coordinate benches of this Court in Cr. Misc. No. 38851 of 2023 vide order dated 01.08.2023 and in Cr. Misc. No. 41967 of 2023 vide order dated 17.08.2023. He further submits that the petitioner is in custody since 31.01.2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail, in connection with Baisi P.S. Case No. 98 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea.
