JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-10-2020 Heard Mr. Ravi Shankar Sahay, learned counsel for the petitioner and Mr. Dashrath Mehta, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Ramgarh P.S. Case No. 181 of 2019 registered for the offence under Section 341 / 323 / 325 / 307 / 506 / 34 of the I.P.C. The allegation against the petitioner as per the First Information Report is that the petitioner assaulted the husband of the informant on his head by means of danda along with other accused persons.
Learned counsel for the petitioner submits that both the parties are agnates and there is land dispute between them. Learned counsel further submits that all the cases which have been mentioned in paragraph no. 3 of this petition as criminal antecedent of the petitioner has been lodged by the side of the informant against the petitioner due to land dispute. Learned counsel referring to Annexure - 3 to this bail application i.e. the
Patna High Court CR. MISC. No.26886 of 2020(2) dt.20-10-2020 2/2 injury report submits that injuries caused to the victim have been found to be simple in nature being superficial. Learned counsel further submits that the petitioner is in custody since 12.12.2019.
Having heard learned counsel for the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 12.12.2019 and both the parties are agnates, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st Kaimur at Bhabua / court concerned in connection with Ramgarh P.S. Case No. 181 of 2019.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
