JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-07-2017 Heard learned Counsel for the petitioner, learned Counsel appearing on behalf of the informant and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Motihari Town Police Station Case No. 796 of 2016, disclosing offences under Sections 386/498A/504/ 506/34 of the Indian Penal Code.

The petitioner no. 2 is the husband of the informant's daughter; whereas the petitioner no. 1 and 3 are father-in-law and mother-in-law respectively of the informant's daughter.

Patna High Court Cr.Misc. No.20320 of 2017 (2) dt.13-07-2017 2/3 The matrimonial discord appears to be the root cause of lodging of the First Information Report. It is submitted that the petitioner shall present himself before the Court as and when required and there is no chance that he will tamper with the evidence or influence the witnesses, if allowed privilege of anticipatory bail.

Considering the nature of accusation and submission advanced on behalf of the petitioners, this application is allowed.

Let the petitioners, namely, Jamadar Singh, Ashutosh Kumar @ Ashutosh Kumar Singh and Madhu Rathaur @ Madhu Rathor @ Madhu Singh, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, at Motihari, in connection with Motihari Town Police Station Case No. 796 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as and when required and in the event of
