Prayer is for grant of pre-arrest bail in Barun P.S. Case No. 138 of 2017 registered under sections 379, 420, 120-B IPC and diverse provisions of Bihar Illegal Mines Act as well as sections 33,41 and 42 of the of the Indian Forest Act. It is stated that the truck owned by the petitioner was found transporting stone chips excavated from the forest land without any valid paper.
Learned counsel for the petitioner submits that he was not aware of the truck being used for carrying the forest produce. He has no criminal antecedents. Referring to the order dated 21.12.2017 (Annexure-2), it is further submitted that coaccused Krishna Kumar Singh, another owner of the truck
Patna High Court Cr.Misc. No.2815 of 2018(2) dt.15-01-2018 2/2 seized by the police, has been granted the privilege of anticipatory bail.
Let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Aurangabad in Barun P.S. Case No. 138 of 2017 on condition that one of the bailors shall be his own/close family member. As soon as the charges are framed the petitioner shall appear in the court below in person on each date fixed thereat. In case of default in doing so, the trial court shall cancel the bail bonds of the petitioner and secure his arrest in accordance with law. (Kishore Kumar Mandal, J) HR/- U T
