The petitioner is married Nanad of the victim Anamika Kumari, who is apprehending her arrest in connection with Hajipur Town P.S. Case No. 351 of 2015 for offence alleged under Sections 147, 149, 341, 323 and 302 of the Indian Penal Code.

Prosecution case as lodged by the father of the victim is of killing of his daughter after nine years of her marriage. It has been submitted by the learned Counsel for the petitioner that she is

No.52592 of 2015 (2) dt.14-12-2015 2 / 2 a married nanad and is living in her Sasural which is quite distant from the place where the husband and the victim lived and she is not concerned with the demand of dowry as alleged and when the alleged occurrence in question took place, she was not present there. It has been further submitted that the father-in-law and mother-in-law of the victim girl has since been granted the privilege of anticipatory bail in Criminal Miscellaneous No.41810 of 2015 dated 12.10.2015 by a Co-ordinate Bench of this Court on similar allegations. I do not propose to take a different view as the petitioner has clean antecedent as is evident from paragraph three of this petition.

Be that as it may, let the above named petitioner, in the event of arrest or surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/-(Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 351 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
