ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.03.2019 in connection with Excise Case No.37 of 2019, P.R. No.57 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the entire recoveries were from the house, which is in the joint possession of the petitioner as well as his brother and therefore, the same cannot be attributed to him. It is further submitted that the petitioner has got no criminal antecedent and has been languishing in jail.

Considering the aforementioned facts and
