This application for regular bail arises out of Gopalganj P.S. Case No. 398 of 2020, disclosing offence punishable under Sections 414/34 of the Indian Penal Code and Sections 30(a), 41(i) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioner's prayer for bail was earlier rejected by this Court by an order dated 03.12.2020, passed in Cr. Misc. No. 31608 of 2020. By filing this application, the petitioner has renewed his prayer for bail.

Allegedly, two vehicles were intercepted by the police carrying illicit liquor. From the vehicle, which was

Patna High Court CR. MISC. No.35531 of 2021(2) dt.04-08-2021 2/2 occupied by the petitioner, 127.620 litres of illicit liquor was recovered.

Learned counsel appearing on behalf of the petitioner has submitted that this Court had earlier granted liberty to the petitioner to renew his prayer for bail after six months and accordingly prayer is being made for grant of regular bail by filing the present application. It is stated that petitioner has no criminal antecedent.

Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional District and Sessions Judge-II-cum- Special Judge, Excise, Gopalganj, in Gopalganj P.S.
