====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Karakat P. S. Case No. 84 of 2016 registered under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code. Accusation is that the petitioner along with three others started installing pillar on the land of the informant. On protest, the aforesaid accused persons including the petitioner surrounded him and started assaulting him by means of lathi, danda and rod. When family members came to rescue him, they were also assaulted by means of fists and slap. Learned counsel appearing on behalf of the petitioner submits that the reason behind the dispute is

Patna High Court Cr.Misc. No.35172 of 2016 (2) dt.02-09-2016 2/2 installation of pole in the disputed land in question. The father of the petitioner also made a complaint against the informant with regard to assault and abuse by the informant and his family. The injuries are simple in nature caused to the informant by hard and blunt substance.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P. S. Case No. 84 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J.) Mishra/- U T
