ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.07.2018 in connection with Charpokhari P.S. Case No. 275 of 2015 (Session Trial No. 421 of 2018) registered for the offence under Sections 364 and 120(B) of the Indian Penal Code and subsequently Section 302 of the Indian Penal Code was added.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR, but his name has surfaced subsequently in the confessional statement made before the police by one Deepak Paswan. It is further submitted that the said Deepak Paswan also taken the name of the another coaccused, namely, Raj Kumar Ram who has since been
Patna High Court CR. MISC. No.24577 of 2019(4) dt.30-09-2019 2/3 extended the privilege of bail by this Court in Cr. Misc. No. 15948 of 2018 vide order dated 08.05.2018. It is further submitted that the petitioner will appear as and when required before the court and may be extended the privilege of bail, as he also stands similarly situated and the confessional statement made before the police has no evidentiary value. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned 4th Additional Sessions Judge-cum-Special Judge, Bhojpur, Ara in connection with Charpokhari P.S. Case No. 257 of 2015 (Session Trial No. 421 of 2018). subject to the following conditions:
(1) One of the bailors will be his father.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
