JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 452, 341, 323, 324, 307, 302, 380 of the Indian Penal Code.
It is alleged that ten accused persons including the petitioners entered into the house of the informant, robbed the household articles and made assault to the informant, informant's father and wife of the informant. It is specifically alleged that co-accused Gandhi Paswan assaulted with lathi to the father of the informant who subsequently succumbed to the injuries.
It is submitted by learned counsel for the petitioners that accusation of assault is only specific against Gandhi Paswan who is not petitioner before this Court.
Patna High Court Cr.Misc. No.53261 of 2015 (2) dt.23-11-2015 2/2 A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Chanpatia P.S. Case No. 41 of 2015, pending in the Court of learned Chief Judicial Magistrate, Bettiah, West Champaran. With the observations above, the application stands disposed off.
