The petitioner, who is the husband of opposite party no. 2, seeks bail in anticipation of his arrest in

Patna High Court CR. MISC. No.25731 of 2020(2) dt.14-10-2020 2/3 connection with Complaint Case No. 2460 of 2018, Tr. No. 3014/2019, dated 04.09.2018, instituted for the offence under Sections 147, 148, 323, 498(a), 313, 354, 504, 506 and 34 of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act.

Learned counsel for the petitioner, at the outset, stated that the petitioner is ready to restore the matrimonial relationship with his wife ( opposite party no. 2) despite differences with her.

Considering the aforesaid stand of the petitioner, it is directed that if the petitioner surrenders before the court below, he shall be granted provision bail and the opposite party no. 2 shall be noticed.

On appearance of opposite party no. 2, an effort shall be made by the court below to explore the possibilities and the modalities of the settlement. Thereafter, the provisional bail of the petitioner shall be confirmed If the opposite party no. 2 fails or refuses to join the matrimonial fold without any plausible cause, that shall also be taken into account while confirming the provisional
