19-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in relation to Phulwari Sharif P.S. Case No. 498/2016 registered under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that thrust of the allegations is against the son of Aaludam and nephew of Mohan who had allegedly shot at the brother of the informant. It is further submitted that in the F.I.R. a suspicion was raised, some more persons are involved behind this occurrence and this petitioner has been involved in course of investigation only for that reason taking him as he is one of the unknown persons.

Patna High Court Cr.Misc. No.6915 of 2018 (2) dt.19-02-2018 Learned counsel for the State is present. There is no direct allegation and any prima facie evidence against this petitioner.

Considering the facts and circumstances of this case, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna, in connection with Phulwari Sharif P.S. Case No. 498/2016, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure, further condition that he will immediately join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall co-operate in course of investigation as also in course of trial.
