Petitioner seeks regular bail in connection with Bidupur PS Case No. 286/2018 registered for the offence punishable under Sections 394, 302, 396 of the IPC. As per First Information Report, the informant was intercepted by unknown criminals who tried to snatch the bag from the informant and upon protest, the accused persons fired upon the informant, due to which, he sustained injuries and during course of treatment, he died.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and during course of
Patna High Court CR. MISC. No.33752 of 2021(5) dt.11-04-2022 2/2 investigation one Deepak Kumar Singh has been arrested and on the basis of his confessional statement, petitioner's name has transpired. He further submits that similarly situated co-accused person, namely, Varun Kumar @ Varun Paswan has been granted bail by this Court vide Cr. Misc. No. 36192/2021. The petitioner is in custody since 12.11.2020. Regards being had to the submissions made by the parties and taking into consideration the criminal antecedent of the petitioner inasmuch as 15 criminal cases of similar nature are pending against him, I am not inclined to grant parity to the petitioner and release him on bail. Accordingly, the same is, hereby, rejected.
Let the trial be expedited.
