The present application has been filed for quashing of the order dated 21/07/2015, passed by the learned Principal Judge, Family Court, Muzaffarpur, in Maintenance Case No. 150 of 2014, preferred under section 125 of the Code of Criminal Procedure, whereby, the petitioner was directed to make payment of Rs.8000/-, per month, from the date of filing of the application to the Opposite Party Nos. 2 and 3 as an interim maintenance.
In view of the ratio laid down in the case of Md. Akil Ahmad Vs. the State of Bihar and Anr. reported in 2016(4) PLJR 968, the learned counsel for the petitioner is permitted to convert the present application into an application under Article 227 of the Constitution of India, within a period of two weeks after Annual Vacation.
