JUSTICE SANJAY PRIYA ORAL ORDER 5/ 14-07-2017 Heard learned counsel for the Petitioner and the State as well as counsel for the Opposite Party No.2. The Petitioner apprehends his arrest in Complaint Case No.1284-C of 2014 instituted for the offence under Section(s) 498-A, 323 Indian Penal Code pending in the Court of the Sub-Divisional Judicial Magistrate, Danapur, Patna. Petitioner is husband of the complainant.
It has been submitted on behalf of the Opposite Party No.2 that cognizance has been taken in the year 2015 and the petitioner is avoiding his arrest. The complainant is always ready to live with the petitioner.
This matter was sent to Mediation Centre. During
Patna High Court Cr.Misc. No.11645 of 2017 (5) dt.14-07-2017 2/2 mediation also, the petitioner did not take any initiative to take the complainant with him.
There is specific allegation of overt act against the petitioner.
In the facts and circumstances of the case, this Court does not find it a fit case for grant of anticipatory bail. Prayer of the petitioner for grant of anticipatory bail is, accordingly, rejected.
The petitioner may surrender in the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
