JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Bihiya P.S. Case No.315 of 2017 registered under Sections 147, 148, 149, 323, 307, 302 and 120B of the Indian Penal Code as well as Section 27 of the Arms Act.

Considering the gravity of the offence as also the allegations made in the FIR that the petitioner was member of the unlawful assembly which surrounded the informant and his brother and three of the named accused opened fire causing injury to the brother of the informant as a result of which he died on the spot, I am not inclined to grant his pre-arrest bail. Accordingly, the application for grant of pre-arrest bail

Patna High Court Cr.Misc. No.9384 of 2018 (2) dt.17-02-2018 2/2 of the petitioner is rejected.

In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
