The petitioners seek pre-arrest bail in connection with Pauthu P. S. Case No. 8 of 2018 registered under Sections 379 and 411 of the Indian Penal Code and 40 of BMMCR, 1972. Considering the nature of allegation and the submission that the petitioners being respective drivers of the respective tractors said to have been seized by the police, having no criminal antecedent were carrying illegally mined sand as per the direction of the owner of the tractors, in the event of arrest or surrender before the court below within six weeks from today, the

Patna High Court Cr.Misc. No.18154 of 2018 (2) dt.05-04-2018 2/2 petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Aurangabad in Pauthu P. S. Case No. 8 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
