The petitioner is in custody since 01.03.2019 in connection with Barh P.S. Case No. 147 of 2018 for the offence registered under Sections 341, 323, 325, 307, 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is case and counter case between the parties with injuries having been inflicted on both sides. It is further submitted that admittedly, there was no intention to kill as the dispute occurred on the spur of the moment on account of keeping a bamboo before the shop of the petitioner and, therefore, the rigours of Section 307 of the Indian Penal Code may not be attracted. Considering the aforesaid facts and circumstances of
