2. At the outset learned counsel for the petitioner seeks permission to withdraw the quashing application with respect to petitioner No.1, Devraj Singh, who died during the pendnecy of the quashing application.
3. Permission is accorded.
4. Accordingly, this quashing application is dismissed
Patna High Court CR. MISC. No.22908 of 2018(2) dt.12-01-2024 2/2 as against petitioner No.1.
5. At the very outset, learned counsel submits that he is not pressing the quashing application on merit for the present and the petitioner would be satisfied if the quashing application is disposed of with a direction to the S.D.M., Sadar, Darbhanga to decide the M.R. Case No. 2300 of 2017 expeditiously and within a time frame.
6. The learned counsel appearing on behalf of the Opposite Party No.2 does not object to the submission made by learned counsel for the petitioner.
7. As such without going into the merits of the case, the Sub Divisional Magistrate, Sadar Dharbhanga is directed to dispose of the M.R. Case No.2300 of 2017 within a period of six months from the date of receipt / production of a copy of this order.
8. The Court expects that the Sub Divisional Magistrate, Sadar Dharbhanga shall not gave unnecessary adjournment to either of the parties.
