The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 504 and 506 of the Indian Penal Code and Sections 25(1-b)a/26 and 35 of the Arms Act.

It is alleged that while the petitioner and other coaccused persons were terrifying the public to cast their votes in their favour, arrested and one pistol was recovered from the possession of co-accused Rakesh Kumar and Rs.10,000/- from other accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the name of the petitioner came into light on

Patna High Court CR. MISC. No.26657 of 2022(2) dt.12-10-2022 2/2 the basis of confessional statement of apprehended co-accused Rakesh Kumar. Petitioner has clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Agiaon Bazar P.S. Case No. 201 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
