JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-07-2022 The learned counsel for the petitioner prays to allow him to withdraw this application, but keeping in view, that the opposite party no. 2 has yet not appeared in this case and her interest is required to be protected while allowing such prayer, this Court directs the learned Principal Judge, Family Court to call both the parties and get satisfied after interacting with them that they are living together and whether the opposite party is not willing to enforce the judgment under revision. If the claim of the petitioner that both the parties have compromised the matter and they are living together is found incorrect and/or the opposite party no. 2 seeks enforcement of the order of

No.390 of 2020(3) dt.08-07-2022 2/2 maintenance the learned Principal Judge shall take appropriate steps to implement the judgment under which the maintenance has been allowed to the opposite party no. 2. With the aforesaid observations and conditions the prayer of the learned counsel for the petitioner to withdraw this application is allowed.
