JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-05-2018 The learned counsel appearing for the petitioner has failed to point out any false statement made by the petitioner, in the bail petition bearing Criminal Misc. No. 61233 of 2017, for the purposes of obtaining bail from this Court, which is the sole ground urged by the petitioner herein for seeking cancellation of bail. The relevant materials on record including the FIR and the impugned order of the learned trial court were perused by this Court and based on the arguments advanced by the learned counsel for the petitioner of Criminal Misc. No. 61233 of 2017, the order under consideration was passed. In fact the opposite party no. 2 was also sent a notice which was duly served but the opposite party no. 2 failed to appear before this Court.
The petitioner herein has failed to show violation of any condition imposed by this Court while granting bail so as to warrant
Patna High Court Cr.Misc. No.25811 of 2018 (2) dt.02-05-2018 2/2 any interference. The present petition lacks bonafide and is an abuse of the process of the Court.
In such view of the matter, there is no merit in the present petition. The same is dismissed.
