Petitioners apprehend their arrest in Mohania P.S. case no. 003 of 2011 instituted for the offence under Section(s) 380 and 120B/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that police has submitted final form in the case. The learned Court below after differing with the final form has took cognizance against these petitioners and other accused persons. The Xerox copy of the order sheet has been enclosed with this bail petition in support of such statements. The learned Court below has mentioned in the impugned order that petitioners have not
Patna High Court Cr.Misc. No.23563 of 2018(2) dt.20-04-2018 2/2 appeared and process under Sections 82 and 83 Cr. P.C. has already been issued against them. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners. Prayer for anticipatory bail of the petitioners stands rejected. Petitioners may surrender before the Court below and make prayer for regular bail which shall be considered and, if possible, disposed off on the same day on its own merit in accordance with law without being prejudiced by the present order (Sanjay Priya, J) shyambihari/- U T
