JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mirganj P.S. Case No. 03 of 2016 registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of the wife of informant along with his two children from her house. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the age of wife of informant is 32 years whereas the age of the petitioner is 20 years. In fact, wife of the informant moved from her house with this petitioner according to her own sweet will. Patna High Court Cr.Misc. No.36504 of 2016 (2) dt.15-09-2016 stated in her statement recorded under Section 164 of the Cr.P.C. on 06.02.2016, she along with her two children was carried forcibly by this petitioner and kept at Delhi and Puna. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Ist, Purnea, in connection with Mirganj P.S. Case No. 03 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
