JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-02-2017 The learned District & Sessions Judge, East Champaran, Motihari vide his Letter No. 102/E dated 28.01.2017 reported that no bail petition has been filed on behalf of accused Moti Lal Jaiswal in Trial No. 980 of 2016, arising out of Chhatauni P.S. Case No. 305 of 2011 after passing order in A.B.P. No. 1535 of 2016.

Learned counsel for the petitioner submits that on the basis of wrong information given by Pairawikar the surrender-cum-bail petition was mentioned before this Bench on 28.11.2016. However, petitioner wants to withdraw this petition.

Accordingly this petition stands dismissed as withdrawn in connection with Trial No. 980 of 2016, arising out of Chatauni P.S. Case No. 305 of 2011.
