2. The petitioner apprehends arrest in Turkauliya P.S. Case No. 548 of 2015 dated 19.07.2015 instituted under Sections 147/148/149/341/323/324/307/448/354/379/504 and 506 of the Indian Penal Code.
3. This is the second attempt of the petitioner seeking anticipatory bail as earlier such prayer was rejected by order dated 30.10.2015 in Cr. Misc. No. 47567 of 2015.
4. After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the application with liberty to surrender before the Court below and seek
Patna High Court Cr.Misc. No.55250 of 2016 dt.19-09-2018 2/2 regular bail.
5. In view thereof, the application stands disposed off as withdrawn with liberty aforesaid observing that in the event of the petitioner surrendering before the Court below within four weeks from today and praying for regular bail, the same shall be considered on its own merits without being prejudiced by the present order. Further, the Court concerned shall take into consideration the fact that all other co-accused have been granted anticipatory bail and as of now, the matter has been compromised between the parties and a formal petition has also been filed as also the fact that there is a counter case in relation to the same incident.
