JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks anticipatory bail in a case registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons kidnapped the daughter of informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim in her statement u/s 164 of the Cr. P. C. has denied the prosecution case and stated that she solemnized marriage with this petitioner out of her own free will. The medical Board assessed her age between 18-19 years. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.26252 of 2022(3) dt.22-11-2022 2/2 prayer for bail.

Considering the facts of the case and the statement of victim recorded u/s 164 of the Cr. P. C. coupled with clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-cumSpecial Judge, POCSO Darbhanga in connection with Ghanshyampur PS case No.111/2021, subject to condition laid down u/s 438(2) of the Cr. P. C..
