The petitioner prays for bail in Udwantnagar P.S.Case No. 128 of 2016 registered under diverse penal provisions of the Arms Act.

It is alleged that on a search one country-made pistol and cartridges of 3.15 bore were recovered form the possession of the petitioner. Similarly, a country-made pistol and one live cartridge were recovered from another co-accused namely Kariman Choudhary.

It is submitted that co-accused Karim Choudhary against whom there are/were some criminal cases pending has been released on bail vide order dated 17.09.2016 passed in Cr. Misc.

Patna High Court Cr.Misc. No.47665 of 2016 (3) dt.30-11-2016 2/2 No. 39443 of 2016. The petitioner is in custody since 05.03.2016. Regard being had to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Bhojpur at Ara in Udwantnagar P. S. Case No. 128 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds and secure his arrest in accordance with law. (Kishore Kumar Mandal, J) HR/- U T
