The petitioners pray for anticipatory bail in connection with Balrampur PS case no. 103 of 2016 registered for the offences punishable under Sections 307 and other sections of the Indian Penal Code.
It has been submitted on behalf of petitioners that petitioners are named in the FIR on the basis of confessional statement of co-accused who has been caught at place of occurrence and petitioners have no criminal antecedent. It has further been submitted that similarly situated co-accused have been enlarged on bail by the Sessions Judge Katihar in B.P. no.
Patna High Court Cr.Misc. No.52124 of 2016 (2) dt.21-12-2016 2/2 1279/16, 1327/16 and 1332/16.
Heard learned APP also.
Having heard both sides and in view of the fact that other similarly situated co accused have already been enlarged on bail by the Sessions Judge itself, let the abovenamed petitioner be surrender before the court below and make prayer for regular bail and lower court after considering this aspect that other co-accused have already been released on bail, dispose of the bail application of the petitioner without being prejudiced by the order of this court on its own merit on the same day.
