2. By order dated 12.07.2022, a report was called for from the Superintendent of Police, Jamui, in respect of the appellant in connection with Sessions Case No. 383 of 1994, arising out of Jamui P.S. Case No. 160 of 1993, within a period of four weeks, as to whether the appellant is alive or dead.

3. A report of the Superintendent of Police, Jamui, vide its Letter No. 147/Legal Cell, dated 04.08.2022 enclosing therewith Memo No. 850/22 dated 31.07.2022,

Patna High Court CR. APP (DB) No.24 of 1996(5) dt.02-08-2023 2/2 issued from the office of the Officer-in-charge, Sikandra Police Station in the signature of the Officer-in-charge, Sikandra Police Station, Jamui, has been received. In the said report, it has been stated that the appellant, namely, Dwarika Mahto in Cr. Appeal (DB) No. 24 of 1996 has already died in the year 2008.

4. Considering the aforesaid report, the present appeal stands abated.
