JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-10-2017 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no.3, Aftamjan Ansari @ Athar Jan Ansari @ Athar Ansari, has already been arrested. Such permission is accorded.

Accordingly, the application of petitioner no. 3 is dismissed as withdrawn.

Heard learned counsel for the petitioners no. 1, 2 and 4 and the learned A.P.P. for the State.

The petitioners no. 1, 2 and 4 apprehend arrest in connection with Dhaka P.S. Case No. 77 of 2017 registered under Sections 147, 149, 447, 504, 341, 323, 354, 506 of the Indian

Patna High Court Cr.Misc. No.33543 of 2017 (4) dt.13-10-2017 2/2 Penal Code and 3⁄4 of the Dian Act.

Learned counsel appearing on behalf of the petitioners submits that the alleged occurrence is false and frivolous. Petitioners are innocent. Further submission is that there case and counter case between the parties.

Having considered the facts and circumstances of the case, let the above named petitioners no. 1, 2 and 4 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Dhaka, District - East Champaran in connection with Dhaka P.S. Case No. 77 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
