Mr. Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RITESH KUMAR ORAL ORDER 16-04-2026 Heard the learned counsel for the petitioner and the learned A.P.P. appearing for the State.

2. The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No.28 of 2026, for allegedly having committed offences under Sections 191(2), 191(3), 190, 270, 285, 137, 76, 223, 126(2), 115(2), 109, 121(1), 121(2) and 352 of the B.N.S., 2023.

As per the prosecution story, which has been lodged by the Police Sub-Inspector to the effect that on 18.01.2026 at about 11:10 a.m., he received information that an accident took place in village Bharpura. On receiving such information, he went to the place of occurrence along with the police party and

Patna High Court CR. MISC. No.24628 of 2026(2) dt.16-04-2026 2/3 Sub-Inspector, Khusboo Kumari. Upon reaching the place of occurrence, the informant directed for taking the injured to the hospital. All of a sudden, angry crowd stopped the movement of the traffic and when the informant tried to pacify them, the mob assaulted the informant and Khusboo Kumari with Lathi, Danda and iron rod, due to which, they suffered injuries. On the basis of the input provided by the local Chowkidar, the petitioner along with others have been named in the F.I.R.

4. The learned counsel for the petitioner submits that the allegations are general and omnibus and no specific allegation has been levelled against any of the accused including the petitioner. He further submits that the doctor has opined the injuries on both the informant and Khusboo Kumari to be simple in nature and the petitioner has got a clean antecedent.

5. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

6. Having heard the learned counsel for the parties and after going through the records, it appears that a mob attacked the police party in which the informant and Khusboo Kumari got injured. However, from perusal of the injury report, which has been annexed as Annexure-2 series to the present petition, it appears that the doctor has opined the injuries on the

7. Taking into consideration the facts aforesaid, let the petitioner, above-named, in the event of his arrest or surrender within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rosera in connection with Bibhutipur P.S. Case No.28 of 2026, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court concerned shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
