The petitioner apprehends his arrest in Alamnagar P.S. Case No. 157 of 2016 under Sections 344, 323, 467, 468, 471, 420 and 120B of the Indian Penal Code.
The informant, Ramchandra @ Ramchandra Choudhary, alleged that Awadhesh Ram and the petitioner fraudulently brought a sale deed in existence, which is alleged to have been executed by the informant.
The learned counsel for the petitioner submits that the informant himself executed the sale deed in favour of the petitioner and Awadhesh Ram. The thumb impression and photographs of the informant appear on the sale deed, Annexure 2. The informant wanted to grab the land of the petitioner after executing the sale deed on one pretext or other. It appears that Ramchandra @ Ramchandra Choudhary executed the sale deed in favour of the petitioner and Awadhesh Ram. Case No. 157 to the satisfaction of the Subdivisional Judicial Magistrate, Udakishunganj, Madhepura, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
