2. The petitioner makes a prayer for bail in connection with Salimpur P.S Case No. 296 of 2025 F.I.R dated 22.10.2025 registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of Arms Act.
3. As per the prosecution case, on 22.10.2025 at about 02:10 A.M., on receiving secret information regarding illegal trade of arms and ammunition, the S.H.O. of Salimpur Police Station along with armed forces conducted a raid at the house of the accused persons. It is alleged that two persons, namely Sonu Kumar and Upendra Kumar @ Chhotu Kumar, were apprehended while trying to flee, and on search of their house,
Patna High Court CR. MISC. No.25296 of 2026(3) dt.13-05-2026 2/3 70 cartridges and three country-made pistols were recovered.
4. Learned counsel for the petitioner submits that petitioner is innocent, has committed no offence and has falsely been implicated in this case. Counsel for the petitioner submits that petitioner is brother of co-accused Upendra Kumar @ Chhotu Kumar and as per allegation, two country-made pistols have been recovered from this petitioner. It has further been submitted that nothing has been recovered from the constructive possession of this petitioner nor was he present at the place of occurrence. Learned counsel for the petitioner submits that similarly situated co-accused person, namely, Upendra Kumar @ Chhotu Kumar has been granted bail by a Co-ordinate Bench of this Court vide order dated 01.04.2026 passed in Cr. Misc. No. 13301 of 2026. Petitioner is languishing in judicial custody since 23.10.2025. Counsel for the petitioner submits that the petitioner has one criminal antecedent in which he is on bail.
5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail.
6. Considering the facts and circumstances, the period of custody and that the similarly situated co-accused person has been granted bail by a Co-ordinate Bench of this Court, the petitioner is enlarged on bail on furnishing bail bond of
Patna High Court CR. MISC. No.25296 of 2026(3) dt.13-05-2026 3/3 Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Barh in connection with Salimpur P.S. Case No. 296 of 2025, subject to the condition that the petitioner shall co-operate in the investigation/trial.
