The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 447 and 504 of
Patna High Court Cr.Misc. No.53208 of 2015 (2) dt.24-11-2015 2/3 the Indian Penal Code.
The prosecution case is that on 10.07.2015 the neighbours of the informant surrounded him and started assaulting him. It is specifically alleged that co-accused Lal Babu Rai assaulted the informant with sword on his beck and right hand, petitioner Dikesh Rai assaulted with danda and snatched rupees five hundred from the pocket, co-accused Holi Rai assaulted with the butt of the pistol on the mouth of the informant and co-accused Mukesh Rai assaulted with bat. It is submitted by learned counsel for the petitioners that specific accusation of assault is against Lal Babu Rai, Dikesh Rai, Holi Rai and Mukesh Rai, who are not the petitioners before this Court except Dikesh Rai. The injury has been found to be superficial simple in nature and the informant has retracted from the initial version and filed a petition to that effect before the learned court below.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial
