JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2017 The present application has been filed for modification of the order dated 27.06.2016 passed in Cr. Misc. No. 5920 of 2016 to the extent of extending the provisional anticipatory bail.

The petitioner being husband of the informant was granted provisional anticipatory bail in a case registered for the offences punishable under Sections 498A, 323, 406, 342, 494, 506 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

On the joint prayer of the parties, the matter was referred to the Mediation & Conciliation Centre of the Bihar State Legal Services Authority. The report of the Mediator at Flag-B dated 11.05.2016 reflects that the issue has been resolved between the parties. Both sides decided to part ways on payment of one time settlement amount of Rs. 10,00,000/- (ten lacs) by the petitioner to the informant till November, 2016. The petitioner agreed to pay Rs. 7000/- per month to the

The petitioner also agreed to bear all the cost of her higher education and marriage. In the circumstances, the petitioner was granted provisional anticipatory bail till November, 2016. The provisional bail was to be confirmed by learned Court below on payment of Rs. 10,00,000/-(ten lacs) till November, 2016 by the petitioner to the informant.

It is submitted by learned counsel for the petitioner that petitioner has already paid Rs. 10,00,000/-(ten lacs) to the informant which gets reflected from Annexure-2 of the modification application.

In the circumstances, the order dated 27.06.2016 passed in Cr. Misc. No. 5920 of 2016 is modified to the extent that the provisional bail granted to the petitioner is extended till 20th of February, 2017. The petitioner is permitted to furnish the bail bonds. The provisional bail of the petitioner will be confirmed by learned Court below on verification of the fact that petitioner has already paid Rs. 10,00,000/-(ten lacs) to the informant.

Accordingly the modification application is disposed of in connection with Maranchi P.S. Case No. 75 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Barh, Patna.
