The petitioner seeks bail in connection with Muffasil P.S. Case No. 444 of 2023 instituted for the offence under Sections 147, 149, 341, 323, 325, 379, 307, 504 & 506 of the Indian Penal Code.

Prosecution case in short is that petitioner got registry of land from the informant's brother and one 'Anand
Patna High Court CR. MISC. No.29072 of 2024(2) dt.20-04-2024 2/3 Kumar' after alluring them. It is further alleged that accused persons, including the petitioner entered into the house of informant and threatened them for filing case and petitioner has assaulted Anand Kumar by means of iron rod on his head. 4.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 23-12-2023. Petitioner bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that there is case and counter case between the parties. Learned counsel for the petitioner submits that injury is found to be simple in nature. It is lastly submitted that charge sheet has already been submitted in this case. 6.
Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on
Patna High Court CR. MISC. No.29072 of 2024(2) dt.20-04-2024 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Muffasil P.S. Case No. 444 of 2023.
