2. The petitioner makes a prayer for bail in connection with Laheri P.S. Case No. 163 of 2025 F.I.R dated 13.04.2025 registered for the offences punishable under Sections 331(2), 305(a) of BNS, 2023.
3. As per prosecution case, on 13.04.2025, the informant received information that the lock of her mother's house was found broken. Upon reaching the house, she found that the locks of the rooms, Godrej and boxes had been broken and several gold and silver ornaments along with a Samsung tab were found missing from the house.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.25222 of 2026(3) dt.13-05-2026 2/3 petitioner is innocent, has committed no offence and has falsely been implicated in this case. It is submitted that petitioner is not named in the FIR, his name has transpired in this case on the basis of confessional statement of the co-accused namely, Anand Kumar. Nothing incriminating is said to have been recovered from the conscious possession of this petitioner. Petitioner is in languishing in judicial custody since 30.06.2025. Counsel for the petitioner submits that the petitioner has nine criminal antecedent and by referring to the judgment passed in the case of Ayub Khan Vs. The State of Rajasthan passed in Cr. Appeal @ Special Leave Petition (Crl.) No. 10587 of 2023, submits that merely because of the antecedent, the consideration of bail may not be denied.
5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail.

Considering the facts and circumstances, the period of custody and the clean antecedent, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, District Nalanda. in connection with Laheri P.S. Case No. 163 of 2025, subject to
Patna High Court CR. MISC. No.25222 of 2026(3) dt.13-05-2026 3/3 the condition that the petitioner shall co-operate in the investigation/trial.
