Case No. 30 of 2017 registered for the offence(s) under section(s) 376 of the Indian Penal Code and 4, 6, 8 of the POCSO Act.

Allegation against the petitioner is of committing heinous offence with the daughter of the informant. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and as per the record, no injury has been found on the person of the victim.

Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to

Patna High Court Cr.Misc. No.33846 of 2017 (2) dt.20-07-2017 2/2 the petitioner.

Let the petitioner surrender before the court below and make prayer for regular bail, which will be considered by the Special Court and the Special Court after considering the submission as stated above and the materials available on record, will pass an appropriate order without being prejudiced by the order of this Court.

Accordingly, this application is dismissed.
