JUSTICE SATYAVRAT VERMA ORAL ORDER 10-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Parsa P. S. Case No.357 of 2019, instituted for the offences under Sections 25(1-AA), 25(1-B), (4)(c ) 26, 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 05.02.2021 and charge-sheet has been submitted in the case.
Allegation is of recovery of one country-made pistol and several articles required for making gun along with partly made sten-gun from Dalan of the petitioner.
The learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and Dalan is an open space and as such, was not aware, who had kept the
Patna High Court CR. MISC. No.35394 of 2021(2) dt.10-01-2022 2/2 said pistol and articles required for making arms. The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody since 05.02.2021 and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Saran/ concerned court in connection with Parsa P. S. Case No.357 of 2019, subject to condition that one of the bailers shall be the father of the petitioner.
The application stands allowed.
