The petitioner who is the elder brother-in-law of the complainant seeks quashing of the order of cognizance dated 17.06.2009 passed by the Chief Judicial Magistrate, Jamui in Jamui P.S. Case No. 98 of 2008, G.R. No. 671 of 2008. The case of the informant is that she was married to the brother of the petitioner on 18.11.2006 where after she came to the matrimonial home. Initially her conjugal life was happy but later on the in-laws started demanding the dowry and finally she was ousted from the matrimonial home.

It has been submitted on behalf of the petitioner that the petitioner never resided in Jamui. He used to stay in Soudi Arabia

Patna High Court Cr.Misc. No.14341 of 2010 dt.28-09-2015 2/2 and the allegation is general and omnibus for the purpose of putting him on trial.

Having gone through the complaint petition, I would be inclined to agree with the submission so raised by the petitioner. Hence the application is allowed and the order of cognizance dated 17.06.2009 passed by the Chief Judicial Magistrate, Jamui in Jamui P.S. Case No. 98 of 2008, G.R. No. 671 of 2008 is hereby set aside so far as the petitioner is concerned.
