The petitioner is apprehending his arrest in connection with Dawath P.S.Case No. 107 of 2016 registered for the offence under Sections 406, 409 and 379 of the Indian Penal Code. Allegation against the petitioner, who claims to be Principal of the college, is that he misappropriated amount of the college.
Submission of learned counsel for the petitioner is that earlier being Principal of the college he has filed case against the Secretary and his son with regard to snatching of money from the cashier and clerk who had gone to deposit the same. It is also submitted that petitioner has deposited amount received by him before the Registrar and Examination Controller and he has produced the papers but now he has been removed from the college by the Secretary and the informant has been made In-
Patna High Court Cr.Misc. No.36529 of 2017 (2) dt.10-08-2017 2/2 charge Principal of the college and, as such, he has falsely been implicated in this case.

Having heard both sides and in view of the facts and circumstances, let petitioner, above named, surrender within a period of four weeks before the court below and on his so surrendering he shall be released on provisional bail till the submission of charge-sheet in this case on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas at Sasaram, in connection with Dawath P.S.Case No. 107 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that he will produce all the papers before the investigating officer, who will examine the matter and if charge-sheet has been submitted against the petitioner in spite of his defence, he must surrender and make prayer for regular bail.
With the above observation, this application is disposed of.
