Petitioner seeks regular bail in connection with Muzaffarpur Town PS Case No. 128/2021 registered for the offence punishable under Sections 272/273/34 of the IPC 30(a) of Bihar Prohibition & Excise Act 2016.
As per prosecution case, 20 litres of illicit liquor has allegedly been recovered from the hutment of the petitioner. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. He further submits that petitioner is not the owner of the hutment from
Patna High Court CR. MISC. No.33755 of 2021(2) dt.22-12-2021 2/2 where illicit liquor has been recovered and the petitioner has been arrested from outside of the hutment.
Learned counsel further submits that petitioner is in custody since 20.02.2021 having no criminal antecedent. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 20.02.2021 having no criminal antecedent and the charge-sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, MD. PAPPU be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Muzaffarpur Town PS Case No. 128/2021.
